Customs Clearance

Products and services to be exhibited at the International Defence Equipment and Services Exhibition “Hemus” are under the control of the respective Bulgarian Authorities and as a rule require approval by The Interministerial Commission for Export Control and Non-Proliferation of Weapons of Mass Destruction (http://exportcontrol.bg/indexen.php), regarding the temporary import and re-export of dual-use articles and technology and Defence-related products.

There are basically two ways to obtain such an approval.

Option one. In case of no doubts that the Exhibitor’s products can be considered as items of the List of Defense Products and the List of dual-use articles and technologies in accordance with the Annex I and IV to Council Regulation (EC) No. 428/2009 (lastly amended by Regulation No. 2268/2017), the Exhibitor will need a License for Participation in Exhibition of Defence Related Products issued by The Interministerial Commission for Export Control and Non-Proliferation of Weapons of Mass Destruction to import and re-export this products.

In order to receive this License the Exhibitors must use the assistance of а Bulgarian natural and legal person (Agent) registered pursuant to the Bulgarian Commerce Act, who is authorized to apply for permission and to submit the required application forms, technical and other information, which must be in Bulgarian language. The issuance of the License would create additional charges for the Exhibitors - for translation of the documents, state taxes, service charge, etc.

On request by the Exhibitors, the Organizers of ‘Hemus 2020’ could propose such licensed legal persons (Agents), who the Exhibitors to work with.

The required information for issuance a License, that the Exhibitors have to provide the licensed legal person (Agent) with includes:

- Copy of document proving the participation in the Exhibition (Proforma invoice, or Form 1);

- List of the product to be temporary imported / re-exported (Form 2);

- For each product, copy of documents proving the origination of the product, way of its acquisition, technical characteristics, purpose of the product.

The Commission may require additional information. 

Option two. In all other cases and in order to ease/relieve the procedures and to facilitate the participation in a Defence Exhibitions the Bulgarian Authorities envisaged another opportunity. If the Exhibitors thinks that the products to be exhibited do not fall into the List of Defense Products and the List of dual-use articles and technologies, they can apply for Opinion on the classification of the product whether they are dual-use articles and technology against Annex I and IV to Council Regulation (EC) No. 428/2009 (lastly amended by Regulation No. 2268/2017), and whether they need permit for temporary import and re-export. The body authorized to give such an Opinion is the Internationally Controlled Trade and Security Directorate of the Ministry of Economy.

Request for Opinion and the required additional information, in English language, can be submitted, electronically, by the Exhibitors, its representatives in Bulgaria, Spedition Company/Agent authorized by the Exhibitors or other legal person.

The Opinion is valid for the Bulgarian Custom Authorities. Its issuance takes 5 days and is free of charge. 

If the Exhibitors wish so, the Organizers of "Hemus 2020" could assist their Exhibitors in the process of requesting the Opinion on the classification mentioned above as Option 2. In such a case, they need to send as soon as possible (but not later than the end of February 2020) the following:   

1. Form 2 - Application for exhibits and demonstrations dully filled out;

2. For each item/product listed in From 2:

- Model, type, CAS, product’s code, position of coincidence in Annex I and IV to Council Regulation (EC) No. 428/2009 (lastly amended by Regulation No. 2268/2017)

- Information from the OEM (drawings, construction, materials, technical data/characteristics, certificates for the results of the analyses of the physical and chemical indicators etc.) which could prove the type and the functional purpose of the product;

- Evidences that the product is mockup, dummy, inert or duly demilitarized.

The information should be sending on E-mail: office@hemusbg.org with copy to manager@hemusbg.org. 

The other case is when the Exhibitors decide to apply for Opinion electronically, by themselves (or by their representatives in Bulgaria or Spedition Company/Agent). In this case they need to send an e-mail to Internationally Controlled Trade and Security Directorate of the Ministry of Economy at:  https://www.mi.government.bg/en/departments/mejdunarodno-kontrolirana-targoviya-i-sigurnost-16-2.html

The e-mail has to contain the following information:

- Attention to: Ministry of Economy, Internationally Controlled Trade and Security Directorate;

- Request for classification of the products and technologies to be exhibited at The XIV-th International Defence Equipment and Services Exhibition – “Hemus 2020”;

- by …….. (Names), ………. (Position), …………. (Company), ……… (UID number or VAT identification number);

- ………….. (Address of the company);

- List of the products, with information about: model, type, CAS, product’s code, position of coincidence in Annex I and IV to Council Regulation (EC) No. 428/2009 (lastly amended by Regulation No. 2268/2017);

- Differences of the products with the  position of coincidence in Annex I and IV to Council Regulation (EC) No. 428/2009 (lastly amended by Regulation No. 2268/2017);

- Additional information about the product by OEM attached to the e-mail.

The following have to be attached to the e-mail as well:

- Document proving the participation in “Hemus 2020” (Proforma-invoice);

- Form 2 – Application for exhibits and demonstrations, dully filled out;

 - For each item/product listed in the e-mail/From 2:

- Information from the OEM (drawings, construction, materials, technical data/characteristics, certificates for the results of the analyses of the physical and chemical indicators etc.) which could prove the type and the functional purpose of the product;

- Evidences that the product is mockup, dummy, inert or duly demilitarized.
